Estate-Real  www.estate-real.com.au (ABN 63094964977)  TERMS AND CONDITIONS OF LISTING/ ADVERTISING   These terms and conditions ('Terms') apply to all advertising provided by www.estate-real.com.au known as Estate-Real   To submit an advertisement/listing with www.estate-real.com.au Customer must provide accurate information and firstly; Be the owner of the business or property being listed/advertised or; Have the authority/ consent of the owner of the property / business being listed/advertised  Subject to these Terms, Estate-Real will use its reasonable endeavours to publish online advertising submitted by Customers ('Advertising') in the format submitted by the Customer and in accordance with the information provided by the Customer when submitting an add/listing. Neither these Terms nor any written or verbal quotation by Estate-Real represent an offer to publish Advertising. A binding contract in relation to a request for Advertising will only be formed between ER and a Customer when Estate-Real accepts Advertising submitted to www.estate-real.com.au   and acceptance of payment for listing services. Even if a contract has been formed in accordance with the above clause, Estate-Real reserves the right to refuse or withdraw from publication any Advertising at any time without giving reasons (even if the Advertising has previously been published by Estate-Real ). Estate-Real reserves the right; To vary the placement of Advertising within a particular title and to change the format Estate-Real will not be liable for any costs, expenses, losses or damages suffered or incurred by a Customer arising from Estate Real’s failure to publish Online advertising with a customer’s request. By submitting Advertising for publication online the Customer warrants to Estate-Real that the Advertising does not breach or infringe: The Trade Practices Act (Cth), Fair Trading Acts (State) and equivalent legislation; State and Commonwealth anti-discrimination legislation; Any copyright, trade mark or obligation of confidentiality; Any law of defamation or obscenity; Any law of contempt of any court, tribunal or royal commission; The Privacy Act (Commonwealth); and Any other law (including but not limited to any common law, statute, delegated legislation, rule and ordinance of the Commonwealth or any State or Territory). The customer must provide full name and address if requested by Estate-Real for issue of receipt or for legal requirements.  All advertising information is provided to Estate-Real by the customer in placing a listing/add, Estate-Real reserves the right to correct typos and will endeavour to contact the customer if unsure of content before placing the listing /add online Estate-Real is not liable for any loss, damages or liabilities arising from a failure of the World Wide Web or any telecommunications structure. The Customer acknowledges that it has not relied on any advice given or representation made by or on behalf of Estate-Real in connection with the Advertising. The customer should check their listing or advertisement at www.estate-real.com.au and edit and update accordingly as a logged on user The customer should notify Estate- Real if any errors in the listing/add published on line. Estate- Real will promptly rectify any problems if advised If a Customer wishes to make a claim on Estate-Real for credit, re-publication or any other remedy in respect of Advertising, the Customer must send the claim in writing or email to Estate-Real no later than 30 days after the date of publication of the Advertising online. It is Estate-Real's  policy to keep the customer satisfied and to make any changes possible to suite customer requirements that are reasonable due to the customers own omission in information first provided.  Estate-Real limits its liability: for breach of any Non-Excludable Condition (to the extent that liability for such breach can by law be limited); and for any other error or omission in published Advertising caused by Estate-Real  to (at Estate-Real' s option) re-supply of the Advertising services affected by the breach, or payment of the cost of re-supply.  pricing ( unless otherwise agreed). Pricing may be varied at any time by Estate-Real without notice; and are inclusive of GST. Estate-Real will provide a tax invoice if requested via email Agents/brokers please note, the Customer's eligibility for discounts and rebates will be based on the Customer's ability to multiple advertise or generate regular advertisers The Customer must pay for Advertising by using paypal and credit cards. The Customer must pay: the full price for Advertising notwithstanding: the fact that Estate-Real has exercised its right to vary the format or placement of the Advertising; and any error or omission in the Advertising (unless the error or omission was the fault of Estate-Real ).   If a Customer fails to pay for Advertising, Estate-Real may remove the customers add/listings from www.este-real.com.au cash pre-payment for further Advertising; charge an accounting fee on all overdue amounts and take proceedings against the Customer for any outstanding amounts; Recover from the Customer all costs relating to any action taken by Estate-Real to recover amounts owing for Advertising, Cease publication of any further Advertising on behalf of the Customer and terminate any agreement in relation to Advertising not yet published; and exercise any other rights at law. Estate-Real reserves the right to withhold any discounts or rebates if the Customer fails to comply with its payment obligations. Estate-Real excludes all implied conditions and warranties from these Terms, except any condition or warranty such as conditions and warranties implied by the Trade Practices Act and equivalent State acts Estate-Real excludes all other liability to the Customer for any costs, expenses, losses and damages suffered or incurred by the Customer in connection with these Terms, whether that liability arises in contract, tort (including by Estate-Real' s negligence) or under statute. Without limitation, Estate-Real will in no circumstances be liable for any indirect or consequential losses, including loss of profits, loss of revenue and loss of business opportunity. The Customer indemnifies Estate-Real and its officers, employees, contractors and agents (the 'Indemnified') against any costs, expenses, losses, damages and liability suffered or incurred by the Indemnified arising from the Customer's breach of these Terms and any negligent or unlawful act or omission of the Customer in connection with the Advertising.   Privacy:   Estate-Real collects a Customer's personal information to provide the Advertising services to the Customer and for invoicing purposes only and will not share a persons information without their consent . Estate-Real may however disclose this personal information to credit reporting agencies and other third parties as part of provision of the Advertising where a Customer has an overdue account, Estate-Real may disclose personal information to debt collection agencies to recover the amount due. Estate-Real will not be liable for any delay or failure to publish Advertising caused by a factor outside Estate-Real' s reasonable control (including but not limited to any Act of God, war, breakdown of plant, industrial dispute, electricity failure, governmental or legal restraint). These Terms are governed by the laws of the state of Victoria, in relation to Advertising published online with www.estate-real.com.au The Estate-Real website and its contents are subject to copyright under the laws of Australia and, through international treaties, other countries. The copyright in materials on this site and in the web-site as a whole is owned by Australian Business Listing Pty Ltd. The copyright in some materials incorporated within this site is owned by third parties.
